1. Our Services

TFUN Sites builds, hosts and manages websites and related lead-capture, scheduling and communication features for martial arts schools. The specific scope, launch timing, revisions, deliverables and support level for a customer are confirmed in the applicable order, proposal or service agreement.

We may change, improve or discontinue a feature when reasonably necessary. We will make commercially reasonable efforts to keep customer websites available, but uninterrupted or error-free service is not guaranteed.

2. Enquiries and Customer Information

You agree to provide accurate, current information when requesting a site or service, including a working contact method and information about your school. You are responsible for reviewing copy, offers, schedules, contact details and other content before and after launch.

Information submitted through this website may be used to respond to your enquiry and provide the requested service as described in our Privacy Policy.

3. Fees, Payment and Cancellation

Fees, billing dates and included services are the amounts and terms shown in your order or service agreement. Unless that agreement says otherwise, recurring services continue until cancelled and approved work or third-party charges may be billed separately.

Either party may cancel a recurring service in accordance with the applicable order or service agreement. Amounts already due, approved work and obligations that are intended to survive cancellation remain payable. We may suspend service for non-payment, misuse or a material breach after reasonable notice where practical.

4. Domains, Email and Third-Party Services

You retain ownership of a domain you own. You authorize us to connect that domain to the website and to make the DNS or hosting changes needed to provide the service. You are responsible for renewing your domain and maintaining accurate registrar information.

Third-party services such as registrars, email providers, analytics tools, scheduling tools, payment processors, advertising platforms and social networks have separate terms and policies. Their availability, decisions, approvals, delivery and data practices are outside our control.

5. Customer Content and Permissions

You retain rights in content, logos, photographs, testimonials and other materials you provide. You grant us a limited license to use, reproduce, edit, format and display that material only as needed to build, host, market or support your requested website and services.

You promise that you have the rights and permissions needed for content you provide, including permissions from people shown in photographs or quoted in testimonials. You are responsible for claims, offers, pricing, health statements, employment information and other customer-facing content on your site.

6. Acceptable Use

You may not use the site or services to violate law, infringe intellectual property or privacy rights, distribute malware, impersonate another person, send unlawful or unwanted messages, collect information without a lawful basis, or publish deceptive, discriminatory, abusive or unsafe content.

You are responsible for obtaining any consent required for lead capture, text messaging, email marketing, cookies, analytics, advertising pixels and testimonials used on your website.

7. Intellectual Property

TFUN Sites and its licensors own the service, platform, original templates, systems, branding and materials we create independently. Except for rights expressly granted in your service agreement, no part of the service may be copied, resold, reverse engineered or used to build a competing service.

Subject to payment and continued compliance with these terms, you may use the completed website deliverables for your school during the service term. Third-party materials remain subject to their own licenses.

8. Advertising and Results

We can build pages and features intended to support enquiries and lead generation, but we do not guarantee rankings, advertising approval, traffic, leads, bookings, memberships, revenue or a particular business result. Google, Meta, Facebook, Instagram and other platforms can change policies or reject content independently.

You are responsible for the legality and accuracy of your claims, offers, marketing, follow-up messages and customer data. We are not your legal, tax, advertising or compliance advisor.

9. Disclaimers and Liability

The site and services are provided on an “as available” and “as is” basis to the maximum extent permitted by law. We disclaim implied warranties that cannot lawfully be excluded, including fitness for a particular purpose, merchantability and non-infringement.

To the maximum extent permitted by law, TFUN Sites and The Follow Up Ninja will not be liable for indirect, incidental, special, consequential or punitive damages, lost profits, lost data, lost leads or business interruption arising from the site or services. Our total liability for a claim will not exceed the fees you paid for the affected service during the period allowed by applicable law.

10. Indemnification

You agree to defend and hold harmless TFUN Sites, The Follow Up Ninja and their personnel from claims, losses, damages and reasonable costs arising from your content, your marketing or communications, your unlawful use of the service, your breach of these terms or your violation of another person’s rights.

11. Changes and Contact
